The court has directed the removal of objectionable material featuring the actress and restrained further unauthorised use of her name, image and voice.

The development comes as celebrities increasingly face concerns over AI-generated deepfakes, manipulated photographs, voice cloning and other forms of digital content created without their consent. In Samantha's case, the material presented before the court included several forms of allegedly unauthorised content.

Samantha approached the Bombay High Court seeking protection of her personality and publicity rights. Her petition raised concerns about the use of her name, photographs, likeness and voice across websites, social media platforms, AI services and other digital platforms.

The case involved 18 defendants, including technology companies, AI developers, digital media entities and other organisations. Samantha also sought protection against unidentified individuals allegedly involved in creating or distributing such material.

Court Orders Removal of Unauthorised Content

Justice Madhav Jamdar passed the interim order after considering the material placed before the court. The Bombay High Court restrained the publication and continued use of objectionable content involving the unauthorised use of Samantha's identity.

The order also covers AI-generated and manipulated material. Platforms were directed to remove the offending content, while further unauthorised use of Samantha's name, image and voice was restrained.

The matter is currently at the interim stage, meaning the court's directions provide protection while the broader legal proceedings continue.

What Did the Court Say About Samantha’s Personality Rights?

The court's observations focused on Samantha's personality and publicity rights, along with her privacy and dignity.

The bench noted that personality and publicity rights are connected with constitutional protections under Article 19(1)(a) and Article 21. The court also referred to the moral rights of performers under Section 38B of the Copyright Act.

The court found that the material before it prima facie indicated infringement of these rights through non-consensual AI-generated deepfakes and morphed content.

This aspect of the case is significant because AI technology makes it increasingly possible to recreate a person's appearance or voice without actually involving that person in the creation of the content.

AI Deepfakes Became a Major Concern in the Case

Samantha's legal complaint reportedly covered several different forms of alleged digital misuse.

Her lawyers pointed to AI-generated voice simulations, manipulated photographs, deepfake videos, explicit material and chatbot personas allegedly using characteristics associated with the actress. Some of the content was also alleged to be misleading or damaging to her reputation and dignity.

The case therefore goes beyond conventional unauthorised use of a celebrity photograph. It also deals with the ability of modern AI tools to reproduce elements of a performer's identity.

Reports say the suit included allegations concerning merchandise, advertisements and online listings that allegedly used her photographs or other aspects of her persona without permission. Samantha Gets Protection While Case Continues

The Bombay High Court has granted ad-interim relief, rather than issuing a final judgment on all issues raised in the lawsuit.

The defendants have been directed to respond through affidavits, while the interim protection continues. Bollywood Hungama reports that the matter is scheduled to be heard next on December 10, 2026.

This means the legal dispute is still ongoing, and further orders could clarify the scope of the protections and the responsibilities of the different defendants.
