Disha Salian Case: Bombay High Court Orders CBI Probe

The Bombay High Court has ordered a CBI investigation into the 2020 death of Disha Salian, former manager of late actor Sushant Singh Rajput. The court has directed the CBI to register an FIR and appoint a senior officer to investigate the circumstances surrounding her death, while making it clear that nobody should be treated as an accused without sufficient evidence.

A major development has emerged in the Disha Salian case, nearly six years after the former celebrity manager died in Mumbai. The Bombay High Court on Wednesday, September 2, ordered the Central Bureau of Investigation (CBI) to take over the investigation into her death and directed that an FIR be registered.

Bombay High Court Orders CBI Investigation

The Bombay High Court passed the order while hearing a petition filed by Disha's father, Satish Salian, who had sought a fresh investigation into the circumstances surrounding his daughter's death.

A division bench comprising Justices Sarang V Kotwal and Ranjitsinha Bhonsale directed the CBI to appoint a senior and experienced officer to conduct the investigation. The court also directed the Malvani Police Station to hand over relevant records to the central agency.

The court has asked the investigating officer to examine all aspects surrounding the circumstances in which Disha lost her life.

FIR Will Now Be Registered

One of the important aspects of Wednesday's order is the direction for registration of an FIR.

The court has also directed the CBI to record the statement of Disha's father as part of the investigation. If the investigation finds sufficient evidence of a cognisable offence, the agency will proceed according to law. If no such offence is established, the investigating officer has been directed to initiate appropriate closure proceedings.

This means the court has ordered a fresh investigation, but it has not concluded that Disha was murdered or that any particular person is guilty.

Court Gives Important Warning About Accused

The Bombay High Court has specifically cautioned against naming anyone as an accused without evidence.

The court made it clear that no individual should be treated as an accused unless the investigating officer finds sufficient material to raise reasonable suspicion against that person.

This clarification is particularly important because several names have been linked to discussions surrounding the case over the years. The CBI will now have to examine the available evidence before deciding whether criminal action is warranted against anyone.

What Did Disha Salian's Family Claim?

Disha's father, Satish Salian, has for years maintained that there were unanswered questions surrounding his daughter's death and sought a deeper investigation.

His petition alleged serious foul play and sought an FIR and CBI probe. His lawyer also raised questions about the manner in which the earlier investigation was conducted and the handling of important documents, including the post-mortem report and Accidental Death Report.

These are allegations made by the family and their counsel, and they have not been established as facts by the court.

What Was the Earlier Police Position?

Disha Salian's death was initially investigated by Mumbai Police as an accidental death case. The police had maintained that she died after falling from the building.

The case later attracted renewed attention following public claims and allegations surrounding the circumstances of her death. The Bombay High Court questioned aspects of the earlier inquiry, including why an Accidental Death Report remained the basis of the investigation for so long.

The latest court order now puts the case under a fresh CBI investigation.

Why Is the Case Linked to Sushant Singh Rajput?

Disha Salian's death became widely discussed because it happened just six days before Sushant Singh Rajput's death.

The two cases have often been discussed together in public and on social media because of their close timing. However, the fact that the deaths occurred days apart does not by itself establish a connection between them.

The CBI's latest investigation into Disha's death will focus on the circumstances surrounding her own death, and the agency will determine what the evidence establishes.

Disha's Father Says He Has Waited Six Years

Following the court's order, Satish Salian expressed relief after years of pursuing the matter.

He said he had been waiting for the development for six years and wanted action against anyone found guilty based on evidence.

For now, the focus shifts to the CBI. The agency will register the FIR, take over the relevant records and conduct a fresh investigation. Whether the probe establishes a criminal offence or leads to a closure report will depend on the evidence collected during the investigation.
